HADAF Center For Human Rights organized a seminar under the title " Freedom Of Speech " in the presence of Salah Abu Hatab and Mahmoud Al-Efranji ( staff in Democracy Unit in the Palestinian Center For Human Rights ) and ( 40 ) female and male university students within its project " Promoting Youth's Rights & Civic Engagement " funded by ( EU & NHRF ).
The seminar focused on freedom of expression, right for peaceful gatherings, and political participation in Universal Human Rights Declaration, and International Treaty of civil and political rights, and to what extent the Palestinian Law is in consistent with international law, and respects democracy and freedom Mahmoud Al-Efranji indicated that democracy parameter in any society can be identified through a study on the extent of inclusion of law to concepts of democracy and application of articles of law on the ground. On the side he indicated that democracy differs from one country to another as we can witness dictatorial countries and other authoritarian countries. He added that the Palestinian Basic Law theoretically is consistent with the international law and criteria Regarding the Palestinian Printing and Publishing Law. It is generally a good law, but still there are some observations on it including that it was issued by the president as the head of the Palestinian Authority and not from the Palestinian Legislative Council and that it gives the right for issuing license to media means to Minister of Communication and not to criteria of law. Moreover this law contains articles that can have different interpretations which makes law loses its importance, and articles that legitimate legal follow, which consequently created self-oversight from the side of journalists and media means which disrupts the right to freedom of speech. |
